3. Foreign Ownership — General Information (Not Legal Advice)

Thailand imposes restrictions on land ownership by foreign nationals. The following information is provided as a general overview only and does not constitute legal advice. You must obtain independent legal counsel from a Thai-qualified lawyer before entering any property transaction.

  • Condominium freehold: Under the Condominium Act B.E. 2522 (1979), foreign nationals may purchase a freehold condominium unit provided the total floor area of foreign-owned units in the same building does not exceed 49% of the total saleable area. Quota availability must be verified with the condominium juristic person or the Land Department prior to purchase.
  • Leasehold: Where freehold purchase by a foreigner is not available, long-term leasehold of up to 30 years (with the possibility of renewal provisions in the lease agreement) is a common alternative. The legal enforceability of renewal options depends on the specific terms of the lease and applicable Thai law.
  • Thai company structure: Some buyers use a Thai-registered company to hold land title. This structure is subject to specific legal requirements under the Land Code and Foreign Business Act. We strongly advise obtaining professional legal and tax advice before pursuing this route.
  • Fund remittance: Foreign buyers of freehold condominiums must transfer purchase funds from abroad in foreign currency and obtain a Foreign Exchange Transaction (FET) form from the receiving Thai bank. This is a mandatory requirement under the Condominium Act.
